Charter of John Pascowe, made to William Hyll [Hull] , and Isabel, his wife. Master John Pascowe, Rector of the parish church of Warmwell, Dorset, son and executor of the will of John Pascowe, grants to William Hyll [Hull] and Isabel, his wife, and their heirs, his burgage on the south side of High Street, opposite les Fysheshamelles, between a burgage of the said town on the west and the tenement of St. John on the east, which burgage he had by grant of said John Pascowe, his father, in his last will, to find a chaplain celebrating and praying for the souls of the said John Pascowe, the father, and Joan, his wife, and all their parents, which will is faithfully fulfilled by a chaplain named Sir Robert Byrtnoll, a copy of which is annexed to this charter, to hold of the King in capite. A dispute having arisen between Thomas Hopkyn, of Dorchester, and Thomas Wilton, of Dorchester, Wardens of the Fraternity of Blessed Mary in the church of St. Peter's, of Dorchester, on the one part, and John Langton, alias didus John Saunders, of Dorchester, on the other part, concerning the right to an annual rent of 5s. which the said Wardens, as in right of the said Chantry, claimed to be issuing from a messuage of the aforewritten John, next the church of All Saints, Dorchester, and the said parties on the intervention of their friends having submitted themselves to stand to the arbitration of Robert Ascogh, clerk, and John Storke, and the said John Saunders has bound himself by his bond in £20 to the said Thomas Hopkyn to observe the decision arrived at ; the said arbitration having heard the parties and having seen their evidences, on 20th November, 32 Henry VI. [1539], was exhibited the will of Margaret Auden, widow, dated 8th July, 1535, 27 Henry VIII., containing, inter alia, " I bequeath to Alexander Auden, my son, and his heirs, my three burgages in Dorchester (i) one on the north side of East Street, between a burgage late John Jurden's on the west and Freernelane, which leads from the said street towards the Friars Minors on the east (Nos. 580-4, 585) ; (2) and two other burgages lying together on the east side of the said lane, between the burgage of Roger Androw on the south and that of the Friars Minors on the north (Nos. 630-1), on condition that for twenty years after my death he and his executors pay from the profits of the said burgages, yearly, to the Wardens of the goods of the church of All Saints, 3s. 4d., with the intention that the said Wardens cause to be celebrated an obit or anniversary during the said term, in the said church, for my soul and the souls of all faithful departed, offering at Mass one penny, and paying to the Rector or Curate immediately after Mass, 4d., and to the parish clerk for tolling the bells, as is accustomed to be done for the dead, 3d. and applying the residue of the aforesaid 3s. 4d. to the repair of the church of All Saints. [Charter of John Stratford.] John Wyllyams and Roger Howell, Wardens of the Fraternity of St. Mary in St. Peter's church, Dorchester, with the unanimous assent and consent of the brethren and sisters of the said Fraternity, and for a certain sum of money, grant to John Stratford, goldesmythe, and his heirs for ever, two burgages in St. Peter's parish, in the western part of High South Street, Dorchester, one between the burgages of said John Stratford on the north and of the Prior or Chaplain of the chapel of St. John Baptist in Dorchester on the south, the other between the burgages of the said Prior on the north and of the Bailiffs of Dorchester on the south, to hold of the chief lords of the fee. Legend, sigul ....Llivovm Dorchester [B5] 703. [Judgment in Cardrowe v. Sampforde and others.] This is an exemplification, 10th May, 8 Elizabeth [1566], of a decree in Chancery in the suit brought by William Cardroe of Cerne, merchant, against Richard Sampforde, George Golde, and Symon Golde. Richard Sampforde, of Ceme, yeoman, was seised in fee of three closes of land, meadow and pasture, called Rodehill, in the parish of Minterne, and of a copse or " springe of woode," with the ground and soil thereof, about 4 acres, in the parish of Hermitage, and divers other lands, etc., under the will of Nicholas Sampforde, his father, for term of years, and to the use of Elizabeth and Mary, daughters of the said Nicholas, and for their education and maintenance. And he, being so seised, about 3 years past agreed to convey the premises to the complainant, William Cardrowe, for 100 marks, and received £56 13s. 4d. of that sum, the rest to be paid thereafter, and promised to make to the complainant a good and sufficient estate in the premises, in fee simple. This the defendant eventually refused to do, and also demised the premises to one, George Golde, " a man of great substance and wealthe and of no lesse frendes and power in the County," and to Simon Golde, his son, for 99 years, who have since cut down, etc., the hedges, quicksettes, and woods growing about the premises. The judgment of the Court was against Sampforde, who was ordered, 28th November, last, before the feast of the Purification following, to convey to the complainant the premises in fee simple, discharged of the lease made to George and Symon Golde, (or else repay him the £56 13s. 4d., together with £20 towards his charges) and receive from him £10, the residue of the 100 marks, and the " obligation " he had made to the plaintiff. Should the defendant refuse to perform either alternative, the possession of the lands would be assigned to the complainant by decree of the Court. And as it appeared that the defendant refused, it is ordered by decree of the Court 6th February, 8 Elizabeth [1566], that the complainant, his heirs and assigns, shall enjoy the premises. A commission is appointed to examine into and assess the waste and spoil done by the defendant and his assigns since 28th November last, which was alleged to have been great, the defendant to satisfy the plaintiff for the same. A. 22. 704. [Fine, Robinson v. Aden.] Fine levied between George Robynson, querent (i.e. complainent) , and Robert Aden, alias Barbett, deforciant, Michaelmas, 17 Elizabeth [1575]. whereby the said Robert acknowledges, for £40, a messuage and garden in Dorchester to be the right of George, which the latter had by gift of said Robert. Warranty. (Cf. 674, 675.) A. 23. 705. [Recovery, Harbyn v. Robynson.] William Harbyn v. George Robynson,* being the recovery of a messuage and garden in Dorchester, suffered in Easter term, 18 Elizabeth. Vouchees, Robert Aden and John Howell. A. 24. * Memorandum written on a small scrap of parchment, — " In this box is an Indenture that leadeth the vse of a fine betwene Georg Robynson and Raulfe Palmer, and it resteth in trust, as well for Mr. Palmer as for Morgan Stone. And for that intent the burgesses have granted to either of them a writing vndur the common seale to sho forth this deed in anie cort, if it bee required: they gave nothing for keeping it." [Robert Warren's Release.] Owin Baylie, son and heir of William Baylie, late of Dorchester, baker, releases to Robert Warren, of Dorchester, inholder, all right in a messuage in the east part of a street or lane leading from High East Street to a lane commonly called Durnegate lane, between burgages of Peter Goodfellowe on the north {sic) and Benet Grey on the north (sic). [Bond by Luke Adyn to Thomas Hardye.] Bond in £200, by Luke Adyn, of Dorchester, gentleman, to Thomas Hardye, of Frampton, gentleman, 5th October, 19 Elizabeth [1577], that the said Thomas Hardye, and his heirs, may peaceably enjoy a messuage on the north side of High East Street, between burgage of John Churchell [Churchill] on the west, and that of John Browne, Esq., on the east, and also a messuage on the north side of Dumegate lane, in the west part of another lane leading from High East Street towards the said Durngate lane, on south of a burgage now or late in tenure of Michaell Taylor, and in the east parte of the burgage of John Hennynge. [Stratford's and Lymster's Bond to Boke.] Bond, 17th May, 35 Elizabeth [1593], by which Laurence Stratforde, of Dorchester, goldsmyth, and Henry Lymster, of Dorchester, gent., are bound to Edward Boke, of Dorchester, feltmaker, in £120, to perform the bargaynes, sales, etc., named in an indenture of bargain and sale of this date, made between Laurence Stratforde and Henry Lyinster of the one part, and Edward Boke of the other part, reciting the sale of six messuages in Dorchester. Allford, to invest for the benefit of her and her children, which he has lent to his brother, John Gardner, now conveys his interest in the premises to said William Allford, of Weymouth and Melcombe Regis, merchant. An indenture, i8th March 1651[-2], by which William Alford, of Yeovill, merchant, and William Gardner, of Weymouth and Melcombe Regis, merchant, reciting the previous deeds, and that the messuage is decayed by neglect of Temperance Gardner, widow, mother of John Gardner, who has a life interest therein, convey their interest in the premises to Gilbert Loder, of Dorchester, gent., for £100.
