Gentleman of Dorchester

Will dated 28 Aug 1841 - Codicil 22 Mar 1844 - Proved 9th April 1850

This is the Last Will and Testament of me  Lawrence ELFORD of Dorchester in the County of Dorset, Gentleman made published and declared this twenty eighth day of August one thousand eight hundred and forty one :

I give and bequeath unto my nephew John GALE of Nottington(1) in the county of Dorset miller all those my dwelling houses and premises situate within and parcel of the Manor of Fordington and which I hold by virtue of Court Roll of the said Manor to hold to him the said John GALE his executors administrators and assigns for and ??during??? all my estate with and interest therein

I give and bequeath the sum of ten pounds yearly to Ann Elford MILES the wife of Frederic MILES for and during the term of her natural life to be paid by half yearly installments And I hereby charge my said copyhold premises with such payment.

I give and bequeath unto the said John GALE the sum of one hundred pounds

I give and bequeath unto Richard HAWKINS(2) of Dorchester aforesaid Gentleman the sum of fifty pounds

I give and bequeath unto Hannah HAWKINS(2) sister of the said Richard HAWKINS the sum of fifty pounds

I give and bequeath unto Louisa MILES daughter of the said Ann ELFORD MILES the sum of fifty pounds

I give and bequeath to my nephew William GALE the sum of one hundred and fifty pounds

I give and bequeath unto to my niece Emma GALE the sum of one hundred pounds

I give and bequeath to the said William GALE household goods and furniture to the value of ten pounds

I give and bequeath unto William DAVIS, Emma DAVIS & Henry DAVIS the children of William DAVIS of Dorchester cabinet maker the sum of five pounds each

I give and bequeath unto Elizabeth DAVIS daughter of John DAVIS of Dorchester aforesaid miller the sum of five pounds

I give and bequeath unto Sarah the wife of the said John DAVIS the sum of five pounds

I give and bequeath unto Charles ELFORD an apprentice to John GALPIN of Dorchester aforesaid ironmonger the sum of ten pounds and my wearing apparel

I give and bequeath unto George HAWKINS the son of William HAWKINS of Dorchester aforesaid cabinet maker the sum of five pounds

I give and bequeath unto my nephew Edmond ELFORD the son of Lionel ELFORD the sum of fifty pounds

I give and bequeath unto my nephew James ELFORD my tools and tool chest,

I give and bequeath unto my godson George DAVIS son of the said John DAVIS the sum of fifty pounds

I give and bequeath the remainder of my household goods and furniture and my plate linen china pictures stock of wine and liqueurs unto the said John GALE and Emma GALE equally to be divided between them share and share alike

I give and bequeath unto the said George HAWKINS and Charles ELFORD the sum of fifty pounds upon the trust following, that is to say upon trust that they the said George HAWKINS and Charles ELFORD do lay out and invest the same in the Savings Bank in the name of Sarah Hannah BARTER the daughter of my niece Jane BARTER and pay and apply the same to the use of the said Sarah Hannah BARTER on her attaining the age of twenty four years with all interest thereon in the mean time but in case she shall not live to attain the age of twenty four years then I give the said sum of fifty pounds with the interest due thereon at the time of her decease unto the children of the said Jane BARTER share and share alike but if there shall be but one thus then living then to such only issue provided nevertheless and my will is that in case there shall be no child of the said Jane BARTER living at the decease of the said Sarah Hannah BARTER Then I give and bequeath the said sum of fifty pounds unto the said Jane BARTER with all interest then due thereon

I give and bequeath unto the said Jane BARTER the sum of fifty pounds

All the Rest Residue and Remainder of my estate and Effects whatsoever and wheresoever and of what nature or kind so ever I give and bequeath unto the said Louisa MILES, the said William GALE, the said Emma GALE, William the son of the said William DAVIS, Sarah the wife of the said John DAVIS, the said Charles ELFORD and the said James ELFORD equally to be divided between them share and share alike

And I Hereby nominate constitute and appoint the said John GALE and the said Richard HAWKINS joint executors of this my will In testimony whereof I have hereunto set my hand and seal the day and year first above written

This is a Codicil - (to the last will and Testament of me  Lawrence ELFORD of Dorchester in the County of Dorset, Gentleman Dated the twenty eighth day of August one thousand eight hundred and forty one And which I direct shall be deemed taken as part thereof

Whereas I have and by my said will given and bequeathed to my niece Jane BARTER the sum of fifty pounds Now I do hereby give and bequeath unto the said jane BARTER the sum of fifty pounds in addition to the sum of fifty pounds so given to her in and by my said will

    Also I give and bequeath to Sarah Hannah BARTER the daughter of my said niece a piano forte

    And in all other respects I confirm my said will

In Witness whereof I have to this Codicil to my said last will and testament set my hand and seal this twenty second day of March in the year of Our Lord one thousand eight hundred and Forty Four

Proved at London with a Codicil 9th April 1850 before the Judge by the oath of Richard HAWKINS one of the executors whom Admons [Administration] was granted having been first sworn by Comon [ the Commission] only to administer power reserved of making the like grant to John GALE the other executor when he shall apply for the same
Genealogical Notes:-

(1). NOTTINGTON, is a hamlet, in the parishes of Broadway and Buckland-Ripers, union of Weymouth, hundred of Culliford-Tree, Dorchester division of Dorset, 3 miles (N.) from Weymouth. John Gale of Nottington who was born at Charminster c1810 is shown in the 1851 Census as a Miller and Farmer of 612 acres of land employing 34 Agricultural labourers and 4 men and a boy in the Mill.

(2). Richard HAWKINS is shown in the 1851 Census living in South Street Dorchester a proprietor of Houses aged 50 living with his unmarried sisters one of which is Hannah aged 54

(3). Elizabeth wife of Lawrence ELFORD of South Back Street was buried at Holy Trinity on 28 Jan 1840; age 68 years

(4). Lawrence ELFORD (1771-1850) was buried at Holy Trinity Church Dorchester on 18 Mar 1850; age 79 years
