Dorset County Gaol, Dorchester - Prison Register 1809 - 1827

I have only extracted the names of people where 'Dorchester' or 'Fordington' has been given as their Parish.

Compiled by Mike Russell OPC for Dorchester & Fordington Aug 2024

[Resident in Dorchester = 95: Resident in Fordington 104 : Total Records 199]

The county-gaol was erected near the site of the old castle in Dorchester, between 1789 and 1795, at an expense of £16,179,
and comprises a gaol, sheriffs' ward, penitentiary, and house of correction; the exterior is handsome,
and the interior is divided into various departments for the classification of prisoners, having four wings,
which, though detached, communicate with the central building by cast-iron bridges

Salisbury and Winchester Journal Monday 24 July 1820 Page 4 : "The Assizes for the County of Dorset will commence at Dorchester on Thursday next ; -----John CRATE for burglariously breaking into the shop and dwelling house of John Gaiger at Beaminster, on the night of 21st January last, and stealing various goods therefrom. (he also stands charged with another felony)" .

Exeter Flying Post and others Thursday 3rd Aug 1820 Page 4 " Dorset Assizes commenced on Thursday last. There were only 12 prisoners on the calendar for trial, six of whom received sentence of death, viz; John CRATE for a burglary in the house of John Gaiger at Beaminster; Thomas Morgan, for a highway robbery, at Beaminster; Thomas Morgan for a highway robbery near Puddletown; james Barnes for sheep stealing at Lytchett Matravers; Charles, John & Moses Blanchard, for a highway robbery near Blandford. The three latter having committed the crime under very aggravated circumstances were left for execution, the rest were reprieved before the judge left the town."

[Note:- Ancestry.com have also imaged the index to this record (Image 44 of 80) which simply confirms John Crates entry to be of Page 43. The problem is that they have indexed it under the Prison Hulk 'Captivity'. John Crate never went anywhere near the Captivity - There were two prison hulks of the same name. The first held prisoners from 1796 to 1816 when the ship was broken up at Portsmouth Harbour. The second took prisoners only from 1824 to 1836 which is after he was sent to New South Wales in Australia on 2nd Oct 1820].

Convict Death Records New South Wales :- Name: "John CRATE - Ship: P Orange - Age: [Blank] - Date of Death: July 2/36 [i.e. 2nd July 1836] - District: Bathurst - Remarks: Murdered "

[Note:- The Ship the 'Prince of Orange' conveyed 136 Convicts from Portsmouth to Port Jackson in New South Wales leaving the 'Downs' off Kent on 8th Oct 1820 and arriving at Port Jackson on 12th Feb 1821. Only one convict died on the voyage. The 'Downs' during the age of sail was a safe area of sheltered water between the strait of Dover and the Thames estuary where ships awaiting an easterly wind to take them into the English Channel gathered, often for quite long periods. So I think John CRATE was placed on board the Prince of Orange in Portsmouth Harbour on 2nd October and she sailed to the downs to await a favourable wind leaving on the 8th. I think this record only records the name of the ship he arrived in Australia on as the 'Prince of Orange' was back in England in 1822 and delivered another 136 prisoners to Horbart on 23rd July 1822.

MURDER:- From – Inquests – New South Wales 1836.  Macquarie University – Colonial Cases
(2020 – Assessment by David Jackson.  The date and location of the murder of John Cruik is consistent with Convict Death Records for John Crate.  It is assessed that these are the same person.  The text below is a transcription and it is believed that a viewing of the original document would show that Crate had been mis-transcribed as Cruik)

[Note:-I have not transcribed the text which gives detailed accounts of witnesses to the arrest and conviction of Patrick alias John Walsh convicted of his murder and sentenced to death, as the end result is that he is acquitted by the Jury. The only additional information about John Crate alias Cruik is the Surgeons account of his examination of his body: -

" Mr. George Busby, Surgeon, examined.---I was called in to examine the body of John Cruik, and I found the deceased lying on his face at the door of the hut, and a great quantity of blood about the floor; he had a number of lacerated wounds on the head, varying from half an inch to three inches in length; the skull was fractured in several places, from which the brain protruded, and on stirring the skull the bones rattled; the back part of the tomahawk must have struck him."

On image 27 the Calendar of Prisoners refers to Richard Larcombe and Ann DART both being convicted of Larcenies and both being transported for 7 years. On image 29 there is a specific reference to "Transport Order Ann DART:-

Whereas Ann DART was Convicted before this Court of Larceny for which offence she was Sentenced to be transported beyond the seas for the term of seven years It is therefore in pursuance of an Act of Parliament made nd passed in the Fith year of the reign of His present Majesty King George the Fourth Instituted "An Act for the Transportation of Offenders from GReat Britain ordered and adjudged by this Court that the above named convict be transported beyond the seas accordingly for the term of seven years to such place or places as His Majesty by and with the advice of His privy council may order and direct."

Link to her entry 25th April 1827 when her case was heard in court and sentenced passed, but the record was never completed as she was buried on that day (25th Apr) at Fordington when her age was recorded as being 76??
