By the Permission of Almighty God I John FFOOT of Dorchester in the County of Dorset Carpenter and Joiner do make and publish this my last Will and Testament in manner following that is to say

In the first place I give and devise unto my Son John FFOOT of Dorchester aforesaid Auctioneer and appraiser and my Son in law Joseph JAMES of Hazlebury Bryant in the said County Yeoman and their heirs all those my freehold cottages or dwellinghouses with the appurtenances situate lying and being in a certain place called Holloway in ffordington in the said County Upon Trust and with full power and authority to sell and dispose of the same freehold cottages or dwellinghouses either by private contract or public auction as they my said Trustees and their heirs shall judge most proper and after such sale either private or otherwise as aforesaid has been finally completed then to divide the money or monies arising therefrom equally between all my children as hereinafter mentioned except the share of my daughter Mary the wife of Jonas FFOOT of Yeovil in the County of Somerset Baker (which it is my Will and desire and I do hereby direct shall be retained by my Executors hereinafter named for the use and benefit of all and every the child and the children of the said Mary FFOOT and to pay such share in equal proportions to them on arriving or attaining their respective ages of twenty one years but in the meantime to place the Amount of such share at interest and Pay and apply the same so far as it shall or will extend towards their several Educations and maintenances.

Also I give and bequeath unto my daughter Elizabeth the wife of the said Joseph JAMES All that my leasehold messuage Burgage or tenement with the appurtenances situate near the Bull Stake or North Street in the Parish of Saint Peter in Dorchester aforesaid in my own occupation and held under the corporation of the same Town for a term of years determinable on lives together with the fixtures therein after mentioned (vizt) all the grates therein or belonging to the same House the Ironing Stove and the Coppers in the back building thereof and which said leasehold house and fixtures I estimate or value at or in the sum of one hundred and twenty pounds to hold to her the said Elizabeth JAMES to and for her own use and benefit notwithstanding Coverture and not subject or liable to the Control debts or Engagements of her present or any after husband but only for her own sole and separate use benefit and disposal and my Will is and I do hereby also direct that the said leasehold messuage Burgage or tenement and fixtures according to what I have estimated or valued the same as shall be reckoned or accounted for and be deemed and taken as part of her share as well as the monies to be received from the sale of the said ffreehold cottages or dwellinghouses at ffordington aforesaid as of the share of household goods and furniture and other the rest residue and remainder of my personal estate and effects herein after directed also to be sold and equally divided anything hereinbefore or herein after contained thereof to the contrary notwithstanding

Also I give and bequeath to my son John FFOOT the sum of ten pounds and the rest of my Tools and to the said Joseph JAMES the sum of five pounds

Also I give and bequeath unto my daughter Ann FFOOT a bed bedstead and furniture with Sheets blankets and Quilt or Counterpane belonging to the same bed and which are in the room where my said daughter Ann FFOOT sleeps together with a looking glass and a mahogany Bason Stand in the same room and also a deal chest of drawers also my household goods bed bedding and furniture (except what I have herein before disposed of to my said daughter Ann FFOOT) and implements of household of every sort kind and description I give and bequeath to all my children equally to be divided the share thereof to my said daughter Mary FFOOT to be for her own sole and separate use benefit and disposal notwithstanding Coverture

And lastly as to the Rest Residue and Remainder of my Goods chattels personal estate and effects of what nature or kindsoever and wheresoever I do hereby direct that the same shall be sold or disposed of by public auction by my Executors hereinafter named and that all the monies produced by such sale together with my ready monies debts and sums of money due and owing to me at my death shall be equally divided between all my said children (the said sum of one hundred and twenty pounds as the valuation mentioned by me of the house herein before given and bequeathed my said daughter Elizabeth JAMES is to be placed against and accounted for as part of such her said different shares as hereinbefore mentioned) And also that from the share of my said daughter Mary FFOOT of the monies arising from the sale of such residue or remainder as aforesaid it shall be lawful to and for my said Son John FFOOT to repay himself the sum of thirty five Pounds which to the account of such sum of thirty five pounds he advanced and Paid on account of his brother in law the said Isaac FFOOT when he was in distress and then the remainder to remain and be for the use and benefit of all her children equally to be divided payable to them respectively at the age of Twenty one years

And I do hereby nominate and appoint my said Son John FFOOT and the said Joseph JAMES Executors of this my said last Will and Testament

PROVED at London 9th Novr 1831 before the judge by the oaths of John FFOOT the son and Joseph JAMES the Executors to whom administration was granted having been first sworn by Comon duly to adminsiter.

Genealogical Notes:-

(1). John FOOT (1762-1831) was buried at All Saints Church Dorchester on 10th April 1831 when he was 69 years old
