Will of Thomas GARLAND of Worgate, Dorset

This is the last Will and Testament of Thomas GARLAND of Worgate in the County of Dorset Yeoman at the time in Perfect Health and Memory and understanding for which great Blessing I thank Almighty God to whose mercifull Goodness I recommend my Soul in the Humblest Manner and my Body in case I dye at Worgate or near Wareham to be Buried in the same Grave with my Dear first Wife in the Church of Lady Saint Mary in the Town of Wareham aforesaid and my desire is to be Buried in as private a manner as Possible

Next as to my Worldly Goods and Property of every Description which it hath Pleas’d Almighty God to Bless me with I Dispose of it as follows

That is to say – I give and Bequeath unto my Daughter Elizabeth or Betty GARLAND the sum of One Thousand Pounds

I also give and Bequeath unto the Children of my Son James Pointer GARLAND that may be living at my Death the sum of One Thousand pounds divided equally amongst them

I also give and Bequeath unto my Dear Wife Elizabeth GARLAND the sum of Twenty Pounds

I also give and Bequeath unto my Son George GARLAND the sum of Twenty Pounds

The aforesaid Legacies to be paid within two Years from the time of my Death and I also give and Bequeath all my Household Goods and Plate to my Son Joseph GARLAND and my Daughter Elizabeth or Betty GARLAND to be Divided equally between them

And Lastly I give and Bequeath all the rest and residue of my Personal Estate of every Description Whatever not Herein before Dispos’d of I give and Bequeath at the Discharging of all my Debts and Funeral Expences to my Son Joseph GARLAND and I do hereby make Constitute and appoint the said Joseph GARLAND as the sole Executor of this my Will being Written in my own Hand Writeing November the Nineteenth In the Year of our Lord one Thousand Eighteen Hundred and Twenty five –

And I do hereby declare that it is not from the want of Affection to my Wife Eliza GARLAND and my Sons John Watts GARLAND and George GARLAND that I have not bequeathed more to them or either of Them But solely Because my Wife Elizabeth GARLAND is provided for in her Marriage Settlement and my Sons George GARLAND and John Watts GARLAND had their share of my property already

I the said Testator Thomas GARLAND declare this to be my last Will and Testament all former Wills being revok’d  Sign’d Seal’d and Publish’d in the presence of

Whereas I Thomas GARLAND of Worgate in the County of Dorset Gentleman have in and by my last Will and Testament Bearing date the Nineteenth Day of November one Thousand Eighteen Hundred and Twenty five appointed my Son Joseph GARLAND sole Executor for the purposes therein mentioned Now do hereby constitute and appoint my Son John Watts GARLAND of the City of Lisbon Portugal, Merchant Joint Executor and trustee with my said Son Joseph GARLAND for the Purposes also therein Mentioned and I do hereby ratify and confirm my said will in all other respects and do declare this ........Writeing to be a Codicil to my said Will and I do direct the same to be annex’d thereto and taken as part thereof

In Witness whereof I the said Thomas GARLAND have to this Codicil set my Hand and Seal this Fourteenth Day of January in the Year of our Lord one Thousand Eight Hundred and Twenty Six
